Privacy Policy for the “Volkswagen Design Contest – ID.3 2050”

A. Controller

Thank you for your interest in taking part in the “Volkswagen Design Contest – ID.3 2050” run by Volkswagen AG, Berliner Ring 2, 38440 Wolfsburg, Germany, info@volkswagen-newsroom.com, entered in the commercial register of the Braunschweig District Court under commercial register number 100484 (“Volkswagen AG”). The following information regards the processing of your personal data by Volkswagen AG in the context of your participation.

B. Processing of your personal data

To mark World Design Day on 27 April 2020, we are asking you to post your 3D model of a Volkswagen ID.3 for 2050 on your personal Instagram account with the hashtag #VolkswagenDesign2050. The Volkswagen Design Team, led by Klaus Bischoff, Executive Director of Volkswagen Design, will select the best three designs within a three-week judging period, and the winners will then be invited to Wolfsburg. Volkswagen AG will create a ¼-scale model for the overall winner of the contest, based on the 3D data.

To enter the contest, please publish images or video of your 3D model on Instagram with the hashtag #VolkswagenDesign2050. In the course of selecting winners, the Volkswagen Design Team will use your personal data published on Instagram. Processing of the personal data logged there is required to run the “Volkswagen Design Contest – ID.3 2050”. Your data will not be stored. Only the personal data of the three winners will be further processed in order that they can be contacted. The data will be processed pursuant to point b) of Article 6(1) GDPR. Volkswagen AG has no influence on data collection and processing by Instagram following publication of models on the participant’s personal account. Details of the purpose and extent of data collection and further processing and use of data by Instagram, including your rights in this regard and settings to help protect your privacy, can be found in the Instagram Data Policy.

To enable us to invite the designers of the three best 3D models to Wolfsburg, Volkswagen AG will process their contact details (first name, surname, phone number and email address). These data are processed to allow winners to be invited to Wolfsburg, and as such are processed on the basis of point b) of Article 6(1) GDPR. The Volkswagen Design Team will contact winners electronically following the selection process, and send a declaration of consent via email. By means of this declaration of consent, winners agree to have their name and images/videos of the 3D models published as part of the press and public relations work carried out by Volkswagen AG in relation to the “Volkswagen Design Contest – ID.3 2050”. Personal data will be published via the company’s website and/or web pages, including but not limited to social media used by the company (Facebook, Twitter, Instagram, Pinterest, YouTube and LinkedIn), and for third parties (media representatives, agency staff, bloggers, influencers). The winners’ personal data will be processed pursuant to point b) of Article 6(1) GDPR based on the consent to be granted separately. Volkswagen also transfers the winners’ details worldwide to countries with a lower level of data protection than the European Union has. Personal data collected from the winners will only be stored for as long as is necessary for the aforementioned purposes, but not beyond withdrawal of the consent to be granted separately, unless a longer retention period is required or permitted by law. The data shall be erased again following withdrawal of consent or when it is no longer required for the aforementioned purposes. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Exceptions to this erasure generally arise due to permanent retention in the Group archive of documents which relate to the company and are of historical significance (e.g. press information), and due to legal provisions. Your data may also, in principle, be stored permanently for archive purposes.

C. Your rights

You may assert the following rights against Volkswagen AG at any time free of charge. Further information regarding protection of your rights can be found under Section C.

Right to information: You have the right to receive information (Article 15 GDPR) from us regarding the processing of your personal data.

Right to rectification: You have the right to request that we rectify (Article 16 GDPR) any incorrect or incomplete personal data relating to you.

Right to erasure: You have the right to request the erasure of your data if the conditions mentioned in Article 17 GDPR have been met. Accordingly, you may, for instance, requested erasure of your data if it is no longer necessary for the purposes for which it was collected. In addition, you may request erasure if we process your data on the basis of your consent and you revoke this consent.

Right to restriction of processing: You have the right to request the processing of your data to be restricted if the requirements of Article 18 GDPR have been met. This is the case if, for instance, you dispute the correctness of your data. You may then request restriction of processing for the period during which the correctness of your data is checked

Right to object: If the processing is based on a predominantly legitimate interest, you have the right to object to the processing of your data. An objection is admissible if the processing is carried out either in the public interest, or on the basis of a legitimate interest of Volkswagen AG or a third party. In the event of an objection, kindly notify us of your reasons for objecting to the data processing. 

In addition, you have the right to object to data processing for the purpose of direct marketing. This also applies to profiling, to the extent it is related to direct marketing.

Right to data portability: If the data processing is carried out on the basis of consent or performance of a contract, and is carried out by automated means, you have the right to receive your data in a structured, commonly used and machine-readable format, and to transmit it to another data processor.

Right of revocation: If the data processing is based on consent, you have the right to revoke your consent at any time, free of charge and with immediate effect.

Right to lodge a complaint: You also have the right to lodge a complaint with the supervisory authority (e.g. with the State Commissioner for Data Protection in Lower Saxony) in respect of our processing of your data.

Conditions of Participation for the “Volkswagen Design Contest – ID.3 2050”

The following conditions apply to participation in the Volkswagen AG contest:

1. Organiser

The organiser of the contest is Volkswagen AG, Berliner Ring 2, 38440 Wolfsburg (hereinafter: “VOLKSWAGEN”), info@volkswagen-newsroom.de entered in the commercial register of the District Court of Braunschweig under commercial register number 100484. VOLKSWAGEN will offer the three winners of the contest, which starts on 27.04.2020 and ends at 12 p.m. on 18.05.2020 (participation phase), the chance to visit the Design Studio in Wolfsburg and the prize of a 1:4 scale 3D print of their submitted design.

The contest is not in any way sponsored, supported or organised by Instagram. The sole point of contact and controller is Volkswagen AG.

2. Participation and exclusion

  • 2.1. Participation is through personal “Instagram accounts”. Participants’ designs must be uploaded to Instagram with the hashtag #VolkswagenDesign2050 by the entry deadline.
  • 2.2. Participants must be 18 years old and have their permanent place of residence in Germany.
  • 2.3. Participants may only take part under their own name. Participation takes place exclusively online. Participants may not submit more than one entry.
  • 2.4. VOLKSWAGEN shall be authorised to exclude from the contest any participants who manipulate the contest process or attempt to influence the contest by unfair means.
  • 2.5. Participation in the contest is free of charge, and is neither dependent on the purchase of goods or services, nor on subscription to a newsletter.
  • 2.6. All participants who undertake the steps listed under section 2.1 during the participation phase will be included in the contest unless they are excluded pursuant to section 2.4.

3. Contest procedure and execution

  • 3.1. The three winners are selected from all participants who undertake the steps listed in section 2.1, and who are not excluded pursuant to sections 2.2 to 2.4. The selection phase will begin at 12 p.m. on 19.05.2020. The winners shall be notified via Instagram private message from 19.05.2020 onwards. Three winners will be selected after the best entries have been judged by Klaus Bischoff, Executive Director of Volkswagen Design, and the Design Team. The prize includes the chance to visit the Design Studio in Wolfsburg and a 1:4 scale 3D print of the submitted design.
  • 3.2. The winners shall be notified via Instagram private message from 19.05.2020 onwards. Winners must send an email to the info@volkswagen-newsroom.de mailbox within 36 hours of the prize notification being sent, otherwise their winner’s claim to the prize shall expire. The prize is non-transferable and is awarded exclusively to winners. No cash equivalent shall be paid and no substitutions made. Any legal recourse is excluded.

4. Responsibility, declaration of consent, granting of rights

  • 4.1. Participants are responsible for the accuracy of the contact details provided. VOLKSWAGEN assumes no liability for the timeliness, completeness or accuracy of the transfer of participant data.
  • 4.2. We require the following personal data from winners: First name and surname, phone number and email address. VOLKSWAGEN shall cover any taxation of non-cash benefit to the value of the prizes. VOLKSWAGEN shall store your data based on compliance requirements. Your data shall not be forwarded to third parties; the exception to this is disclosure during company audits.

5. Liability

  • 5.1. The liability of VOLKSWAGEN and its vicarious agents for breach of obligations arising from ordinary negligence shall be excluded, with the exception of any breach of material contractual obligations (obligations which must be fulfilled for proper implementation of the contract, and performance of which the other party can normally rely on) and of injury to life, limb, and health. The liability of VOLKSWAGEN shall be limited to compensation for foreseeable, contractually typical and direct losses in accordance with the relevant performance.
  • 5.2. VOLKSWAGEN assumes no liability for health risks of participants in relation to participation in the contest. Participation is at the participant’s own risk.

6. Early termination of the contest

  • 6.1. VOLKSWAGEN shall reserve the right to cancel or suspend the contest at any time without prior notice. This shall apply in particular if proper implementation of the contest cannot be guaranteed on technical grounds (e.g. viruses in the computer system, tampering or defects in hardware and/or software), due to manipulation of the participation process, or on legal grounds.
  • 6.2. Claims by the participant for performance and compensation owing to early termination of the contest pursuant to section 6.1 are excluded within the provisions of section 5.

7. Final provisions

  • 7.1. The contest is subject to German law if applicable.
  • 7.2. If individual provisions of these Conditions of Participation are invalid, the validity of the remaining provisions shall be unaffected.
  • 7.3. Volkswagen is neither willing nor obligated to take part in dispute resolution before a consumer arbitration board.

The specified fuel consumption and emission data are determined in accordance with the measurement procedures prescribed by law. 1 January 2022, the WLTP test cycle completely replaced the NEDC test cycle and therefore no NEDC values are available for new type approved vehicles after that date.

This information does not refer to a single vehicle and is not part of the offer but is only intended for comparison between different types of vehicles. Additional equipment and accessories (additional components, tyre formats, etc.) can alter relevant vehicle parameters such as weight, rolling resistance and aerodynamics, affecting the vehicle's fuel consumption, power consumption, CO2 emissions and driving performance values in addition to weather and traffic conditions and individual driving behavior.

Due to more realistic testing conditions, fuel consumption and CO2 emissions measured according to WLTP will in many cases be higher than the values measured according to NEDC. As a result, the taxation of vehicles may change accordingly as of 1 September 2018. For further information on the differences between WLTP and NEDC, please visit www.volkswagen.de/wltp.
